A grand jury indicted two teens on murder charges in the death of a 9-year-old girl at her Old East Dallas apartment in August.

Tyrese Simmons and Davonte Benton are accused of fatally shooting Brandoniya Bennett on Aug. 14 in her apartment in the 3500 block of Munger Avenue. Police said Simmons was feuding with someone who lived in the complex and fired into the wrong home.

Both 19-year-olds were originally charged with capital murder, but Thursday’s indictment did not include a capital count for either teen, according to the Dallas Morning News.

Capitol murder is punished with a life sentence or the death penalty. Murder is punished with a prison term of five to 99 years or life in prison.
