Calling all creatives! Your neighborhood Advocate Magazine is updating its t-shirts and we wanted to put the design of our new look out there to all of the neighborhood talent. We are looking for a design that really pops, but is about the Advocate and the Dallas neighborhoods that we serve. JUDGING

The Advocate and its Staff will pick 10 finalists who we determine best reach the challenge and meet the guidelines. Then it’s up to the public to choose the winner. Finalists are selected by The Advocate and Staff based on originality, entertainment value, and adherence to contest guidelines. Grand Prize and Runner up prize winners are selected by public voting. The Advocate and Staff may select any design(s) to be featured online as part of our ongoing promotions.

All work must be original, and belong to you. If you use copyrighted image to which you do not have the rights then we cannot accept your submission.There is no limit on how many designs you submit.

Official Rules

ELIGIBILITY: The Advocate T-Shirt Contest (“the Contest”) is open only to residents of Dallas County, who are of any age. Groups and individuals are welcome to participate with the knowledge that only (1) one Grand Prize will be given. Employees, officers and representatives of The Advocate Magazines (the “Sponsor”), their parents, their immediate family members (parents, children, siblings and spouses) and persons living in the same household (whether related or not), are not eligible to participate in the Contest. Participation constitutes entrant’s full and unconditional agreement to and acceptance of these official rules.

Timing: The Contest begins at 12:00am Pacific Daylight Time (“CMT”) on July 1, 2010 and ends at 11:59pm CMT on Aug 1, 2010 (“Contest Period”). The Contest Period consists of a Submission Phase (the “Submission Phase”), a Judging Phase (the “Judging Phase”), and a Voting Phase (the “Voting Phase”) as set forth in the chart below.

HOW TO ENTER: During the Submission Phase, participants may enter by visiting the AdvocateMag.com/Contest page. Once on the page they then navigate to the ‘Design Contest’ link and follow the links and Contest instructions to register. Participants must complete all requested information and then either upload and submit a t-shirt design or designs may also be dropped off, with the form, on DVD or CD at The Advocate office at 6301 Gaston Avenue #820 Dallas, TX 75214. Once submitted, the Submission, cannot be deleted, canceled or modified.

Only one design per form. Entrants allowed to have multiple Submissions during the Contest Period. All entries must be received by the contest closing date 11:59 pm CMT on Aug 1, 2010. All submissions become the property of Sponsor and will not be acknowledged or returned. We reserve the right to feature any submission as part of our promotional campaign .

Design Submission Guidelines: Submissions must from vector images for quality of printing. Submissions must be the original work of the person who registered and created and uploaded design. Contestant must be the sole owner of the copyright of any images he or she submits. By entering a Submission, each Contestant guarantees that he or she is the author and copyright holder of the Submission. Sponsor will not assist any Contestant with the development or production of a Submission. By entering a Submission, each Contestant agrees to authorize Sponsor to conduct a background check on him or her. In addition, by entering, each Contestant represents and warrants that Submission (i) does not infringe any other person’s or entity’s rights; and (ii) has not been submitted previously in a Contest of any kind. Submission must not contain any unauthorized third-party owned material, including, but not limited to, trademarks, logos, textures, photography, depictions of actors and the like. Additionally, Contestant represents and warrants that he or she will not have and will not acquire any trademark rights, copyrights, or any other rights in or to Sponsor’s trademarks, trade names, logos or other intellectual property. Sponsor specifically reserves all its rights to protect its intellectual property against any infringement or other illegal or improper use.

Judging Phase/Voting Phase: During the Judging Phase, the Submissions will be reviewed by qualified judges, Advocate staff members, to ensure that they comply with the Submission guidelines outlined in these Official Rules. Judges will evaluate all eligible Submissions based on the following objective criteria: 30% Originality, 40% Creativity, and 30% Public Appeal (the “Judging Criteria.”) In the event of a tie, judges will use the score for Creativity to break the tie. Judges will select a maximum of ten (10) finalists (each a “Finalist”) based on the scores earned by their Submissions. During the Voting Phase, the Submissions of the ten (10) Finalists will be displayed on the advocatemag.com/contest page. Visitors to the page (each a “Visitor”) will be invited to vote for the Submission they believe expresses the best interpretation of the challenge based on the Judging Criteria. Limit: One (1) vote per person during the Voting Phase. Visitors are not permitted to share the same email/IP address. Any attempt by any Visitor to submit more than the stated number of votes by using multiple/different email addresses, mailing addresses, identities or any other methods will void that Visitor’s entries and he or she will be disqualified from further participation in the Contest. The Finalist whose Submission accumulates the most votes will be the potential Contest Grand Prize Winner. The Finalists whose Submissions accumulate the next (3) three highest number of votes will be the runner up winners. In the event of a tie the Sponsor’s judges will re-judge tied entries based on the Judging Criteria until one (1) Finalist is determined to be the Grand Prize Winner and three (3) Runners up.

CONDITIONS: Submissions which are deemed inappropriate, indecent, obscene, or disparaging of the Sponsor, as determined by Sponsor in its sole discretion, will be disqualified. Proof of submission or sending is not proof of receipt by Sponsor. All Submissions become the exclusive property of Sponsor and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt and publish any or all of the Submissions, and may use them in any media in association with the Sponsor without attribution or compensation to the Contestant, his/her successors or assigns, or any other entity unless prohibited by law. Entry of a Submission in this Contest constitutes Contestant’s irrevocable assignment, conveyance, and transference to Sponsor of all right, title, and interest in the Submission, including, without limitation, all copyrights. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, or misdirected Submissions, which are void.

PRIZES: One (1) grand prize winner will receive a $500 gift card to the Apple Store that can also be used online. This is the value of the basic iPad but does not have to be used solely for the purchase of the iPad. (ARV $500). Three (3) runners up will receive prizes to be determined. No substitution, assignment, or transfer of any prize permitted except at Sponsor’s sole discretion. Prize is non-transferable, with no cash redemption or equivalent. Sponsor reserves the right to substitute a prize or prize component of equal or greater value. Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prize awarded. Sponsor makes no representation or warranties concerning the appearance, safety or performance of any prize awarded.

WINNER VERIFICATION: All potential winners will be notified by email or mail, potential Finalists on or about Aug 2, 2010 and potential Grand Prize Winner and Runners Up on or about Aug 6, 2010. Additional information will be requested at that time. All prizes may not be awarded in the event an insufficient number of eligible entries are received that meet the minimum criteria established by the judges. Winners must provide a high quality version of their video to The Advocate before prizes will be awarded. If any correspondence of the Sponsor or any prize is returned as undeliverable or if winner refuses /is unable to provide a high quality copy of their video, the corresponding prize may be forfeited and awarded to an alternate winner at the sole discretion of Sponsor. By accepting prize, winner consents to Sponsor use of his/her name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law. Upon delivery to the winner’s address, Sponsor will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize.

INTERNET LIMITATIONS OF LIABILITY: If for any reason the online portion of the Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, or for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in the Contest or downloading any materials in the Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

GENERAL CONDITIONS: This contest is subject to all applicable federal, state, and local laws, and is void where prohibited. By participating, you agree to be bound by these Official Rules and the decisions of the Administrator, and you waive any right to claim ambiguity in the Contest or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless Sponsor and Administrator, their respective agencies and vendors associated with the Contest, and the respective officers and employees of all these entities, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in any aspect of this Contest.
